1 INTELLECTUAL PROPERTY AND COPYRIGHT

1.1. Intellectual and industrial property rights of Skillled

1.1.1. All content displayed on the Platform and, in particular, videos, designs, drawings, texts, graphics, logos, icons, buttons, software, trade names, trademarks or any other signs capable of generating intellectual, industrial property rights, to the image itself or any other on intangible assets, are owned by Skillled, or third parties with whom an agreement has been reached for their legitimate exploitation. Specifically, Skillled has received as many assignments of rights and/or use licenses as are necessary for the exploitation of the Platform.

1.1.2. In no case will it be understood that the access, navigation and use of the Platform and the services by the Freelancer implies a resignation, transmission, license or total or partial assignment of said rights by Skillled. The Freelancer has a license to use the Platform, and specifically, strictly for the services offered.

1.1.3. Any reference to trademarks or registered trade names, or other distinctive signs, whether owned by Skillled or by third-party companies, in which case they are licensed to Skillled for their use and/or exploitation, implicitly prohibits their use without consent. of Skillled or its legitimate owners or licensees. At no time, unless previously and expressly stated to the contrary by Skillled and its legitimate owners or licensees, does the access, navigation or use of the Platform and/or its services grant the User any right to the distinctive signs included in it.

1.1.4. All intellectual and industrial property rights and copyrights are reserved to Skillled, and any others that may fall on the contents, intangible assets and/or services of the Platform and, in particular, it is prohibited to modify, copy, reproduce, communicate publicly, make available, transform or distribute, by any means and in any way, the Platform and/or all or part of the contents included in the Platform, including, but not limited to, texts, images, brands, graphics, logos, buttons, software files, color combinations, as well as the structure, selection, arrangement and presentation of its contents, without prejudice to the rights that third parties may have over any of the elements that make up the content. All this, without prejudice to having the prior, express and written authorization of Skillled or, where appropriate, the holder of the corresponding rights. Likewise, and for security reasons, it is not allowed to use "frames" or mechanisms that alter or vary the design, original configuration or contents of the Platform.

1.1.5. None of the content hosted on the Platform may be downloaded, reproduced or used on any other device or place other than the Platform, unless Skillled has enabled the means to do so.

2.2. Intellectual and industrial property rights of the User:

2.2.1. If the Freelancer publishes any type of content through the Platform and specifically on his dashboard, he guarantees: (i) that he has all the rights over them and/or has the necessary authorizations for it (ii) that neither the publication of said content or the exercise of the licenses granted below will infringe or violate the rights of any third party.

2.2.2. In this sense, the Freelancer hereby grants a free, non-exclusive license, for everyone and without time limitation, to Skillled and its affiliates to use, reproduce, distribute, communicate publicly (in all its modalities), transform and, in any way, exploit such protected content and/or any other intangible assets uploaded to the Platform, in any medium, modality and/or format, and for any purpose.

2.2.3. Skillled appreciates the Freelancer's comments and suggestions about his experience as a User of the Platform. In this sense, the Freelancer authorizes Skillled to publish, disseminate, reproduce, distribute, transmit, include in any type of presentations, brochures, website, etc., the testimonials made by the Freelancer on any social network or by other means, either spontaneously or upon request by Skillled. In this way, the Freelancer expressly authorizes Skillled, in a non-exclusive, free manner, for everyone and without time limitation, to use said comments and/or testimonials from the User for any purpose (including commercial), including any photograph, image , text and/or video that is part of them, including in the Freelancer's profile,

3.3. Notifications for irregular content

3.3.1. If the Freelancer becomes aware of the existence of any content that is illegal, illegal, contrary to the law, security breach or that could entail an infringement of intellectual, industrial or any other property rights, they must immediately notify Skillled by writing to complaints @Skillled.com , so that Skillled can take effective knowledge and take the appropriate measures, as soon as possible.

Skillled respects the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Skillled's copyright agent with the information specified below in the form of a "Notice of Alleged Infringement." It is Skillled's policy to respond to clear Suspected Infringement Notices, and our policy is designed to make sending Suspected Infringement Notices as easy as possible while reducing the number of Notices we receive that are fraudulent or difficult to find. understand or verify. If you are a User or Subscriber and are concerned about removal or blocking of access to your content, please provide Skillled's copyright agent with the written information specified below in the form of a "Counter-Notification". 3.3.2 DMCA NOTIFICATION OF ALLEGED COPYRIGHT INFRINGEMENT

If you wish to make a claim of copyright infringement for material, please substantiate each claim by sending Skillled's Registered Copyright Agent a Notice of Claimed Infringement to the email or postal address below:

To be considered effective, a Notice of Alleged Infringement must be in writing and include the following information:

• Physical or electronic signature of the owner, or a person authorized to act on the owner's behalf, of an exclusive copyright that is claimed to have been infringed
• Identification of the copyrighted material that is claimed to have been infringed
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity that is to be removed or access to which is to be disabled
• Information reasonably sufficient to permit Skillled to locate the material that is claimed to be infringing or to be the subject of infringing activity
• Information reasonably sufficient to allow Skillled to contact the person submitting the Notification, such as a physical address, email address, and telephone number
• A statement that the person submitting the Notice has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the Notice is accurate and, under penalty of perjury, that the person submitting the Notice is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
